The Alaska Month to Month Lease Agreement is a beneficial way of documenting an agreement where two parties wish to enter a lessor-lessee relationship. This type of lease provides a documented framework where one person (lessee) pays a predetermined sum of money in exchange to for the right to reside on or within a lessor’s property for a period of one month with the understanding this will automatically renew without a notice to quit. While this type of agreement is often verbal, there are a number of advantages to putting it in writing. For instance, a written month-to-month lease requires a thirty-day notice be issued thirty days before either party may cancel the agreement. This provides a certain assurance that an illegal eviction will not occur to the tenant while the landlord enjoys a sense of security that rent will be paid for the duration of the agreement.

A written lease will also help avoid any misunderstandings as a result of miscommunication and prevent any terms from being forgotten. This document will outline each party’s responsibilities and both parties should review the document carefully. Once this document is signed and dated by tenant and landlord, the courts will hold both responsible for living up to their individual responsibilities as outlined by the agreement.

How to Write

Step 1 – The first paragraph will require the landlord name, tenant name, and date to be entered.

Step 2 – The next section, “Premises,” must give the specific address to be rented.

Step 3 – The “Lease Term” section must have the date the lease begins input.

Step 4 – The “Lease Payment” section will need the dollar amount that is to be paid each month. It will also define the month and year this is to begin.

Step 5 – The “Late Charges” section will define the grace period given to the tenant to pay the rent in full. The next area to fill out will define the late charges per day the tenant must pay if this is not done. The last area to fill in this paragraph will define the absolute due day this money must be received if the tenant wishes to avoid penalties/eviction.

Step 6 – The “Insufficient Funds” section will name the dollar amount a tenant must pay for a bounced check. According to Alaska State Law, this must be included in the lease if the landlord expects compensation for any charges incurred.

Step 7 – The “Security Deposit” section requires the dollar amount of the security deposit. It will also name the terms of the security deposit.

Step 8 – The next several paragraphs will outline specific terms for the tenant/landlord relationship to operate in. The “Occupants” paragraph will require the number of tenants living in the space to be filled out. The “Utilities and Services” paragraph will define what the landlord is responsible for providing. The “Pets” paragraph will name a fee/pet if one is expected by the landlord. The “Abandonment” paragraph will require the number of days a tenant is absent from a property before considering it abandoned. The number of days the tenant is missing while rent is outstanding must also be defined.

Step 9 – The “Additional Terms and Conditions” section will have several areas to fill out. The first section “Display Signs” will require the number of days a landlord may advertise via sign that a unit will be available for rent. The “Noise” paragraph will require the time range that furniture may be moved in or removed. The “Parking Paragraph” will have a checkbox that either allows or disallows a tenant from a parking space. If a parking space is available where it is located and how many vehicles a tenant may park there must be defined. The “Balconies” paragraph will have a checkbox defining whether a tenant is allowed to use a balcony for the actions listed in this paragraph. All parts of this section should be read and evaluated carefully as both parties will be held to these terms.

Step 10 – The final section is the signature section and vehicle information. The landlord, agent, and all tenants must sign in the appropriate areas, write in the date, and print their name.  If the tenant has a vehicle, they may input the Make/Model, Year, Color, and License Plate Number in the spaces provided under the heading Vehicle Information.
