The Maryland Association of Realtors Residential Lease Agreement Template is a standardized contract form which may be used to document the rental contract a lessor and lessee shall enter. This is a significant agreement due to the level of commitment and money involved. Both parties are responsible for certain conditions of the property as well as to each other. It is therefore, highly recommended to have paper in hand reporting precisely what was agreed to and bearing the signature of each party involved. This will make such an agreement easier to prove in a court of law as opposed to a verbal one.

This contract will require several disclosures to be made. Also, one will need to fill out the blank spaces where negotiable items specific to the two signature parties and the property will define the agreement. Finally, any addendums or additional agreements meant to be considered part of this lease should be attached and clearly labeled (as well as signed and dated) in order to be protected by the lease’s binding effect. It is worth noting that a space indicating a walk thru checklist is included. This is a particularly important attachment as it will define the security deposit to be returned once this agreement terminates.

How to Write

Step 1 – On the first line enter the full name of any Listing Broker, Listing Agent, Leasing Broker, and/or leasing agent involved along with the contact phone number.

Step2 – In Item 1, enter the date of this lease. Do this by filling in the first three blank lines with the calendar day, month, and year of the lease. Then enter the full name of the Landlord and the full name of the Tenant in the remaining two blank spaces.

Step 3 – In Item 2, enter the address of the premises to be rented. Do this by entering the street address, unit number (if applicable), City, State, Zip Code, and Subdivision or Condominium (if applicable).

Step 4 – In Item 4, write out the monthly rent amount the Tenant must pay in the first blank space then, in the second, enter this amount numerically. Next, enter where the rent is to be delivered. If there is a receiving party, include that individual’s full name.

Step 5 –  In Item 4, below the basic rent information there is an opportunity to report Pro-Rated Rent information. If this is applicable enter the start date of the pro-rate period, the end date of the pro-rate period, the dollar amount the tenant must pay for this period, and the due date for pro-rated rent.

Step 6 – In Item 4, on the last line enter the total rent amount that will be received by the end of the lease. Write it out on the first blank space here then enter it numerically in the parenthesis.

Step 7 – In Item 5, enter the name of everyone allowed to live with the lease holding Tenant.

Step 8 – In Item 6, the first two lines will be where to report the fixtures and appliances that are on the premises the Tenant has access to. If there are any defects to the premises that should be noted enter them in the last line of this section.

Step 9 – In Item 7, enter the security deposit amount the landlord requires of the tenant in the spaces provided.

Step 10 – In Item 8, define the type of community the rental property is located in by checking Condominium Association, Homeowners Association, or Neither. If applicable, enter the name of the Community Association in the blank space provided.

Step 11 – In Item 9, enter the coverage amount in liability insurance the Tenant must insure the property for in the spaces provided.

Step 12 – In Item 10, enter the deductible amount for repairs to the property involved in the blank spaces provided.

Step 13 – In Item 11, enter the number of days before the end of a lease where the landlord may advertise and show a “For Rent” sign and a “For Sale” sign.

Step 14 – In Item 12, enter the full contact information where the Landlord or Lessor may receive any notices concerning the property from the Tenant.

Step 15 – In Item 36, each Tenant and each Landlord participating in this lease should initial this box if both wish for the stated renewal provision to be active.

Step 16 – In Item 44, indicate if there is an addendum attached to this lease.

Step 17 – Each page must be signed by each party

Step 18 – At the bottom of this document, each Tenant, Landlord, and Witness Present, must sign his or her name. The Landlord and Tenant must date their signature. There will also be a space for each signing party to have a seal on the signature line. Finally the Date of Ratification (day of signing and notarization) will have a line.
