The Minnesota Association of Realtors Residential Lease Agreement Template can be used to solidify both Month-to-Month and Fixed Term Tenancies. This is a pretty handy option to have when one has long-term plans to rent one or more properties as a form of income. The benefits of having a written lease are fairly clear. It exists as a written document that both parties sign. The signature shall verify to any reviewing entity that all individuals involved have discussed, agreed to, and are ready, willing, and able to live up to the responsibilities that will be assigned to them in this contract.

Keep in mind that once signed this contract will remain in effect for the full lifetime. This puts quite an emphasis when it is time to choose the term of the lease. While there are no guarantees for long-term tenancy with a month-to-month tenancy there is also a form of safety since a fixed term lease will be enforceable in a court of law from its start date until its termination date save for very few exceptions. Once this document is signed by both parties it will solidify this agreement in the eyes of a Minnesota court.

How To Write

Step 1 – Enter the Landlord’s full name on the first line.

Step 2 – Enter all the Tenants who will be signing the lease on the second line.

Step 3 – Enter dwelling number, street address, city, zip code, garage number (if applicable), storage unit number (if applicable), and parking stall number (if applicable) of the property being rented.

Step 4 – In the “Term of Lease” paragraph, enter the number of months this lease shall be in effect or write in the words “month-to-month” to indicate the time frame of this lease’s lifespan. Below this enter the start date of the agreement then (if applicable) the end date.

Step 5 – Next define the money that shall be involved, locate the line starting with “Monthly Rent” then enter the rent which the tenant must pay each month, the late fee the tenant must pay if late, and the security deposit amount from the tenant the landlord will be holding. If there are other expenses to the tenant, they must be reported on the blank line next to the words “Other Charges.” Lastly, enter the individual and address these rent payments and other expenses should be submitted to.

Step 6 – The next set of lines will be where the landlord or property owner must document an address for where official notices regarding the property or lease should be sent from the tenant. Enter the recipient’s name, address, city, state, zip code, office hours, email, and telephone number.

Step 7 – In the next section, labeled “Utilities, “check off the utilities and/or services the tenant will be responsible for paying for. There will be a box labeled “None” if the tenant will not be held responsible for any that are listed.

Step 8 – The section labeled as “Cable/Internet,” will have two boxes regarding this service.

If the tenant is responsible for all expenses associated with this service, mark the first box. If the tenant is not responsible for basic service but has the option to upgrade at their own expense, then mark the second box.

Step 9 – In “Landscape and Snow Removal,” select the actions the tenant is responsible for taking by marking the appropriate box. There will be a box marked as “None” in cases where the landlord (or a service the landlord employs) will perform these services however, Tenants should make sure to read the paragraph in this section.

Step 10 – The next section will give an opportunity to list disclosures, addendums, and agreements that will be attached to this lease and treated as part of this contract. These boxes (Acknowledgements, Lead Paint Disclosure, Amenities Addendum, Pet Addendum, and Other) should be checked and described in the space below if that item will apply.

Step 11 – The “Terms of Lease” section will have several items that are imperative to the lease. That is, each should be defined. In Item 2 of this section, enter the total sum of money the tenant must pay over the lifetime of the lease on the first blank line. Then on the second blank line, enter the monthly rental payment the tenant must submit to the landlord by the first of the month.

Step 12 – In Item 4 of this section, enter the total security deposit the landlord will require of the tenant on the first blank line. On the second blank line in this item, enter the due date for this amount.

Step 13 – At the end of this document, each tenant involved must sign and print his/her name as well as provide a date for this signature. Below this will be an area for the Property Manager to sign his/her name, provide a date for the signature, and print his/her name.
