Signing Requirements
The principal is required to authorize in the presence of one witness and a notary public (§ 10-6B-5). Note that, under an executive order issued by the Georgia governor in April 2020, remote attestation, such as via video, is temporarily permitted to effectuate powers of attorney.
Definition of “Durable”
“Durable” means not terminated by the principal’s incapacity (§ 10-6B-2(2).
Definition of “Power of Attorney”
“Power of attorney” means a writing or other record that grants authority to a person to act in the place of an individual, whether or not such term is used (§ 10-6B-2(7).
