You provide us with personal information when you use or access our Services, such as when you draft and save an electronic form or document, sign up for an eForms account, or interact with our customer support through our Website’s chat, phone, or email features.
The types of personal information we collect will depend on which of our Services you access or use. For instance, we collect any personal information you submit to sign up for an eForms account, such as your email address and login credentials. If you use any of our Services to create an electronic document or form, we collect the personal information you enter through the course of drafting, generating, and editing the document or form. If you make any purchase to use our Services, we collect your billing and credit card information.
Additionally, you may provide information by typing or using speech-to-text if you use our Website’s chat integrations, such as our Lawyer Chat feature. Audio is collected only to transcribe it into text, encrypted during transmission, and either promptly discarded or retained briefly to improve transcription accuracy. You may opt to type instead. Information you provide, including intake responses, is collected to deliver the requested service and connect you with a live expert upon request.
As you access, use, and navigate our Website, we may automatically collect information about your computer equipment and browsing actions through the use of certain automatic tracking technologies that do not individually identify you. This information may include, but is not limited to, your IP address, browser type, domain name, access times, operating system, cookie information, referring website addresses, and certain technical details of your visit to our Website, such as the web pages visited, links clicked, and text entered. We abide by applicable data protection laws to ensure we use the personal information you provide us to fulfill, deliver, and achieve the purposes for which we collect it.
We retain personal information for the length of time needed to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law. For example, we use and store the personal information you enter on one of our electronic documents or forms to generate, deliver, and save the personalized document you created. We also use and store your personal information, such as your email address, name, or telephone number, to verify your identity and carry out any requests you make through the use of our Services, including when you communicate with customer support through our Website’s chat, phone, or email features.
Furthermore, we use and store any financial information you provide us when making a purchase for our Services, such as when you purchase a single document or subscribe to a recurring plan (including any free-trial period), in order to process the corresponding payment and prevent any transactional fraud. We may also use the personal information you provide us to inform you of other products or services available from eForms or its affiliates that may be of interest to you, deliver custom advertisements through third-party advertising platforms, or ask you to participate in surveys that help us understand your opinions and feedback of our Services or of potential new services that we may offer. For example, we may ask you to provide feedback after you have interacted with one of our customer support agents.
We may disclose your personal information to third-party vendors or processors that allow us to deliver the Services and perform certain functions that support or improve our Services.
This may include disclosing personal information as required for us to provide customer support, process secure payment transactions, send email correspondence, perform statistical analysis about our Services, and provide other types of customer-relationship management and fulfillment. We may also disclose your information to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce or apply our Terms of Use and other agreements, including billing and collection purposes, and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of eForms, our customers, or others.
While we do not sell personal information for monetary consideration, some of our use of third-party analytics and advertising technologies may qualify as a “sale” or “sharing” of personal information under applicable state privacy laws. Please refer to Sections 5 and 7 of this Policy for more information about these technologies and your rights and choices regarding them. eForms is not responsible for the privacy statements, data practices, or any other content, services, or products on third-party websites or services, nor do we control how third-party websites collect information or how they may use it. We make no representations about any third-party automatic data collection technologies or mechanisms. We only share browser-level data, basic identifiers, or similar data about the use of our Website with third-party vendor tracking technologies like Google Analytics, which collects, tracks, and reports website traffic through third-party cookies and similar technologies. We may use cookies, web beacons, or similar technologies to optimize your experience with our Services and recognize when you visit our Website. “Cookies” are small data files containing small amounts of information that are placed on your computer or mobile device when you visit a website. Cookies are widely used to make websites work, function more efficiently, and provide reporting information. Cookies help us to remember things about your visit to our Website, such as your preferred language and other choices or settings that generally make our Website easier for you to use. They may also be used to deliver advertisements that are relevant to you.
We also use first-party data to understand how our users interact with our Website and Services. This allows us to ensure functionality and improve our Website and Services based on concrete user-experience data. Accordingly, we use third-party data providers to process and measure first-party data, such as page visits, content viewed, Services used, and general usage patterns or other such activity from our users’ interaction with our Website and Services. The data these advertising technologies collect may include pseudonymous identifiers that can be linked to other data about you, that is, it is not necessarily anonymous. If you opt out, through our “Your Privacy Choices” page or a recognized browser signal such as Global Privacy Control (GPC), we cease sending your data to these advertising platforms, including Meta, LinkedIn, and Google Ads.
You can exercise your choices about advertising technologies at any time through our “Your Privacy Choices” page or by sending a recognized opt-out signal like Global Privacy Control (GPC). Additionally, third-party controls are available. Third-party advertising and tracking services offer you the opportunity to opt out of their tracking systems or adjust your ad preferences. You can manage your Meta ad preferences by visiting Meta’s “Ad Preferences” page. You may also opt out of making your activities related to cookies available to Google Analytics by installing their opt-out browser add-on. We secure your personal information on our servers in a controlled and secure environment protected from unauthorized access, use, or disclosure. We also encrypt account information during transmission to other websites using protocols such as Secure Socket Layer (SSL).
You are solely responsible for preventing the unauthorized use of any personal information associated with accessing your eForms account, such as your login name or password. By using our Services, you agree that you are responsible for any activity under your eForms account, whether you authorized such activity or not. Furthermore, you agree to notify us immediately of any unauthorized use of your account.
Certain states have consumer privacy laws that provide their residents with specific rights related to their personal information. This section describes some of those rights and explains how eligible state residents may exercise their rights under applicable law.
A state’s consumer privacy law may grant its residents the right to delete any personal information we may have collected and stored about them, subject to certain exemptions (“right to delete”). Additionally, a state’s consumer privacy law may provide its residents with the rights to access or review any eligible personal information we may have collected, stored, or otherwise processed (“right to know”) as well as the right to correct any inaccurate personal information we may have collected, processed, or stored (“right to correct”).
Generally, a consumer’s rights to delete, know, and correct are not absolute rights. For example, we may deny a request to delete if retaining the personal information is necessary for us or our service providers to serve our ongoing business relationship with the requestor. We may also deny such request if we are required to retain the personal information for any business purpose stated in this Policy or when retention is necessary for us to comply with a legal obligation or order. Additionally, we may deny such requests and retain personal information to make other internal and lawful uses of the information that are compatible with the context in which it was provided. In any event, we will evaluate consumer requests by considering the totality of the circumstances.
If you are an eligible resident protected by a state’s consumer privacy law and wish to exercise your privacy rights to delete, know, or correct, you may submit a description of your verifiable consumer request to us via email at privacy@eforms.com. Only you or someone legally authorized to act on your behalf (an “authorized representative”) may submit a request to know, delete, or correct related to your personal information.
Any request to know, delete, or correct must:
- Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative (e.g., by sending a request from the email address associated with your eForms account); and
- Describe the request with sufficient detail for us to properly understand, evaluate, and respond to it.
We cannot respond to requests or provide access to personal information if we cannot verify your identity or authority to make the request. In most cases, we consider requests made through your password-protected eForms account sufficiently verified when the request relates to the personal information associated with that specific account. Still, you may be asked to provide additional information to verify your identity if we deem it necessary. We will only use the personal information provided in the request to verify your identity or authority. We strive to respond substantively to all verifiable requests within a reasonable amount of time after receipt. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to the email address linked to that account. If you do not have an account with us, we will deliver our written response via email to the email address used to make the request.
Any disclosures we provide will only cover the 12-month period preceding our receipt of the request. If we cannot comply with the request, our response will explain or describe the reason. For a request to know, we will attempt to provide the applicable information in a format that is readily usable and able to be transmitted from one entity to another entity without hindrance. We do not charge a fee to process or respond to verifiable requests unless it is excessive, repetitive, or manifestly unfounded. If we determine that such a request warrants a fee, we will explain to the requestor why we made that decision and provide a cost estimate before completing the request.
Certain states’ consumer privacy laws also provide their residents with the right to opt out of third-party information sharing for commercial purposes (“right to opt out”). If you wish to opt out of the sale or sharing of your personal information for cross-context behavioral advertising or other commercial purposes, you may do so at any time by visiting our “Your Privacy Choices” page or by sending a request to privacy@eforms.com. You do not need an eForms account to opt out. Furthermore, our Website recognizes and honors opt-out preference signals sent by your browser or device, including the Global Privacy Control (GPC), and treats a recognized signal as an opt-out for that browser or device. When we process an opt-out request or a recognized signal, we will confirm that your preference has been applied. Opting out will stop applicable sale, sharing, targeted advertising, and ad-platform tracking, but will not disable cookies or processing that are strictly necessary for security, authentication, fraud prevention, payment, or other operational functions.
We will not discriminate against you for exercising your state consumer rights. Unless permitted by applicable law, we will not deny you any of our Services, nor will we charge you different prices or rates for our Services, including through granting discounts or other benefits or imposing penalties.
Our Services are not targeted, designed, or intended for use by persons under the age of 18, and such use is prohibited by our Terms of Use. We do not knowingly or directly collect personal information from persons under the age of 18. If you become aware that a child has provided us with personal information, please contact us immediately at privacy@eforms.com.
We may amend this Policy at any time and for any reason, such as to reflect changes in the law or our data practices. Our use of the data we collect is subject to the Policy in effect at the time we use such data.
