  1. Collection of Personal Information

You provide us with personal information when you use or access our Services, such as when you draft and save an electronic form or document, sign up for an eForms account, or interact with our customer support through our Website’s chat, phone, or email features.

 

The types of personal information we collect will depend on which of our Services you access or use. For instance, we collect any personal information you submit to sign up for an eForms account, such as your email address and login credentials. If you use any of our Services to create an electronic document or form, we collect the personal information you enter through the course of drafting, generating, and editing the document or form. If you make any purchase to use our Services, we collect your billing and credit card information.

We also use and store your personal information, such as your email address, name, or telephone number, to verify your identity and carry out any requests you make through the use of our Services, including when you communicate with customer support through our Website’s chat, phone, or email features. 

 

Furthermore, we use and store any financial information you provide us when making a purchase for our Services, such as when you purchase a single document or subscribe to a recurring plan (including any free-trial period), in order to process the corresponding payment and prevent any transactional fraud. We may also use the personal information you provide us to inform you of other products or services available from eForms or its affiliates that may be of interest to you, deliver custom advertisements through third-party advertising platforms, or ask you to participate in surveys that help us understand your opinions and feedback of our Services or of potential new services that we may offer. We do not see the individual user’s personal information; the user is anonymous. Additionally, we may deny such requests and retain personal information to make other internal and lawful uses of the information that are compatible with the context in which it was provided. In any event, we will evaluate consumer requests by considering the totality of the circumstances.

 

If you are an eligible resident protected by a state’s consumer privacy law and wish to exercise your privacy rights to delete, know, or correct, you may submit a description of your verifiable consumer request to us via email at privacy@eforms.com. Only you or someone legally authorized to act on your behalf (an “authorized representative”) may submit a request to know, delete, or correct related to your personal information.

 

Any request to know, delete, or correct must

  • Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative (e.g., by sending a request from the email address associated with your eForms account); and
  • Describe the request with sufficient detail for us to properly understand, evaluate, and respond to it. 

 

We cannot respond to requests or provide access to personal information if we cannot verify your identity or authority to make the request. In most cases, we consider requests made through your password-protected eForms account sufficiently verified when the request relates to the personal information associated with that specific account. Still, you may be asked to provide additional information to verify your identity if we deem it necessary. We will only use the personal information provided in the request to verify your identity or authority. We strive to respond substantively to all verifiable requests within a reasonable amount of time after receipt. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to the email address linked to that account. If you do not have an account with us, we will deliver our written response via email to the email address used to make the request. 

 

Any disclosures we provide will only cover the 12-month period preceding our receipt of the request. If we cannot comply with the request, our response will explain or describe the reason. For a request to know, we will attempt to provide the applicable information in a format that is readily usable and able to be transmitted from one entity to another entity without hindrance. We do not charge a fee to process or respond to verifiable requests unless it is excessive, repetitive, or manifestly unfounded. If we determine that such a request warrants a fee, we will explain to the requestor why we made that decision and provide a cost estimate before completing the request.

 

Certain states’ consumer privacy laws also provide their residents with the right to opt out of third-party information sharing for commercial purposes (“right to opt out”). If you wish to opt out of third-party personal information sharing for commercial purposes, you may do so by visiting our “Do Not Sell or Share My Personal Information” page. Note that we collect, store, and use your personal information as described in this Policy when you create an eForms account using your email address. Therefore, you must have created an eForms account to opt out of third-party personal information sharing.

 

We will not discriminate against you for exercising your state consumer rights. Unless permitted by applicable law, we will not deny you any of our Services, nor will we charge you different prices or rates for our Services, including through granting discounts or other benefits or imposing penalties.

Our Services are not targeted, designed, or intended for use by persons under the age of 18, and such use is prohibited by our Terms of Use. We do not knowingly or directly collect personal information from persons under the age of 18.
