A domestic partner affidavit is a declaration made by a couple to acknowledge that they are engaged in a domestic partnership under state law. This gives each partner special rights (such as hospital visitation, inheritance, etc.) without being legally married.
Notary Acknowledgment – It is commonly required for this form to be notarized.
Common Requirements
- 18 years or older
- Must live together for 6-12 months (depending on the state)
- Cannot be married or in a domestic partnership with someone else

Is a Domestic Partnership Legal?
Domestic partnerships are legal in eight states and one district:
- California[1]
- District of Columbia[2]
- *Hawaii[3]
- Maine[4]
- Nevada[5]
- New Jersey[6]
- Oregon[7]
- Washington[8]
- Wisconsin[9]
*Hawaii allows for “reciprocal beneficiaries,” which have similar rights as domestic partnerships.
