A domestic partner affidavit is a declaration made by a couple that both acknowledge being engaged in a domestic partnership (under state law). This gives each partner special rights (such as hospital visitation, inheritance, etc.) without being legally married.
Notary Acknowledgment – It is commonly required for this form to be notarized.
Common Requirements
- 18 years or older;
- Must live together for 6-12 months (depends on the State); and
- Cannot be married or in a domestic partnership with someone else.

Is a Domestic Partnership Legal?
Domestic partnerships are legal in eight (8) States and one (1) district:
- California (FAM 297.1)
- District of Columbia (§ 32-702)
- *Hawaii (§ 572C-4)
- Maine (22 § 2710)
- Nevada (NRS 122A.200)
- New Jersey (§ 26:8A-4)
- Oregon (ORS 106.310)
- Washington (RCW 26.60.030)
- Wisconsin (§ 770.05)
*Hawaii allows for ‘reciprocal beneficiaries’ that have similar rights as domestic partnerships.
Is Gay Marriage Legal?
Yes, in Obergefell v. Hodges (2015), it was determined that same-sex couples have the right to marry. This struck down all State bans on gay marriage and made it legal to all individuals.
