A New Mexico notice to pay or quit (non-payment) is a document used to inform a tenant that their rent is past due. The notice presents the tenant with the option to either pay the rent in full within three days or deliver possession of the dwelling.

Laws

  • Notice Period: Three days.[1]
  • Rent Grace Period: None, rent is due at the time and place established in the lease agreement.[2]
  • Maximum Late Fee: 10% of the total rent for each rental period in which the resident is in default.[3]

Delivery Options (3)

  1. Hand delivering the notice directly to the tenant;
  2. Sending by first-class mail; or
  3. Posting the notice on an exterior door of the unit.[4]

Waiver of Landlord’s Right to Terminate

If the tenant pays the full amount due within the three days after they have received notice, any action for the nonpayment of rent is barred.[1]
