A parent may not use this form to delegate parental powers regarding a child who is subject to the jurisdiction of the juvenile court under s. 48.13, 48.14, 938.12, 938.13, or 938.14, Wis. Stats.

(1) If a child has another living parent whose whereabouts are known and who is willing and able to provide care and custody for the child, a parent may not leave the child with another person unless the other parent consents to the appointment in writing. (2) You may not appoint a temporary agent if your parental rights have been terminated or you have signed a voluntary surrender.

Laws

Maximum Term: For grandparents: unlimited duration. For military deployment: length of deployment, plus 30 days.^[1] For all other reasons: 1 year.^[2]
Signing Requirements: Must be signed under oath and notarized. A copy must be filed within ten days of the power of attorney being executed, in the probate court of the county in which the child resides.^[3]
