Agent’s Duties – The agent must deliver a copy of the seller’s property condition disclosure statement to any potential buyer within 72 hours of receiving an offer to purchase.[1]
If the property is offered for sale without a listing agreement, the agent must provide the seller with a blank property disclosure form. Once completed and signed by the seller, the agent must provide a copy to the buyer within 120 hours of executing the purchase agreement.[2]

Seller’s Disclosure of Property Condition (required) – As Kentucky is not a buyer-beware state, the seller of a residential property must provide the buyer with full disclosure of the condition of the property prior to signing a purchase agreement.

Lead-Based Paint Disclosure (conditional) – It is required that the seller of a building constructed prior to 1978 provide all potential buyers with a lead-based paint disclosure statement that details any toxic paint used on the premises at any time.[3]
