An Arizona separation agreement lets couples determine their rights and obligations regarding property, spousal support, and other related matters without getting divorced. Separation agreements are used by people who no longer want to live together as spouses, but do not wish to end their marriage formally.
Is a Separation Agreement Legal in Arizona?
Yes, a separation agreement may be entered between a couple that includes:
- Disposition of property;
- Separation of debts;
- Child support and parenting time; and
- Alimony.

Requirements for Legal Separation
- Filing Fee: $234 (Civil Court Filing Fees)
- Residency: One (1) of the spouses must be a resident for at least 90 days (ARS § 25-312(1)(A)).
- Where to File: At a Superior Court Location where the petitioner resides.
