A Louisiana separation agreement lets certain married couples establish terms for a period when they do not wish to live together as spouses but are not ready to pursue a divorce. In Louisiana, legal separation is only available to couples in covenant marriages, a marriage in which couples agree ahead of time to very limited circumstances under which they may get divorced.
For couples in covenant marriages, a separation agreement can accomplish many of the same things as a divorce decree.
Is a Separation Agreement Legal In Louisiana?
Yes, but only for couples who pursued a covenant marriage.

Legal Separation Requirements
- Filing Fee: Varies by parish; Ascension Parish, for example, is $355, while Jefferson Parish is $400
- Residency: The couple are living in the state and the reason for the separation occurred in the state, or the person seeking the separation was living in the state before reason for the separation occurred and is living there at the time of filing (§ 9:308)
- Where to File: With the district court covering the parish where the filing spouse resides, or if applicable with the East Baton Rouge Parish Family Court
