A Maine separation agreement is a legal document that allows married couples to live apart without pursuing a full divorce. Separation agreements let spouses set rules on alimony, child support, and property division (much like a divorce).
In Maine, separation agreements are available to couples that “desire to live apart for a period in excess of 60 continuous days.”
Is a Separation Agreement Legal in Maine?
Yes, couples may agree to petition a court for a decree of judicial separation that settles disposition of property, spousal support, and parental rights and responsibilities.

Legal Separation Requirements
- Filing Fee: $120
- Residency: One of the following: the non-filing spouse (respondent) is a resident of Maine; both spouses have lived in Maine for at least six months; the filing spouse (petitioner) is a Maine resident and was married in Maine; or, the petitioner is a Maine resident and was living in Maine when the cause of the separation arose
- Where to File: With the district court assigned to the town where the petitioner resides or where respondent will be served
