A Maine separation agreement is a legal document that allows married couples to live apart without pursuing a full divorce. Spouses can use this agreement to set terms on alimony, child support, and property division. In Maine, separation agreements are available to couples that "desire to live apart for a period in excess of 60 continuous days."

Legal Separation Requirements

  • Filing Fee: $120
  • Residency: One of the following: the non-filing spouse (respondent) is a resident of Maine; both spouses have lived in Maine for at least six months; the filing spouse (petitioner) is a Maine resident and was married in Maine; or, the petitioner is a Maine resident and was living in Maine when the cause of the separation arose
  • Where to File: With the district court assigned to the town where the petitioner resides or where respondent will be served
