A Pennsylvania separation agreement allows married couples to set terms regarding the allocation of marital property, alimony, and other matters for the period beginning when they choose to stop living together.

Separation agreements provide an alternative to divorce. Pennsylvania is one of a small number of states that do not recognize separation as a distinct legal status, but couples can still form agreements and enforce them like other contracts. Terms regarding child support and child custody, however, may be modified if a court determines they are not in a child’s best interest.

Is a Separation Agreement Legal in Pennsylvania?

Yes, couples may form private separation agreements, but the state does not recognize separation as a distinct legal status, so they may need to pursue alternatives to address certain matters or if they cannot come to an agreement.
