The Indiana small estate affidavit is used to gather the assets of a person who has died with $50,000 or less in assets. The affidavit cannot be filed earlier than 45 days after the date of death and it must be signed in front of a notary public. In addition, there cannot have been an opening of the estate in probate. The small estate affidavit provides a simplified method of handling a small estate without having to go through the probate process.

How to Write

Step 1 – Write in the following in the first box:

  • Name of person who died
  • His or her social security number
  • Date of death
  • Residential address at the time of death

Step 2- In the next section, write in your name as the affiant.

Step 3 – Write in the names, addresses and percentage interests of the heirs in the spaces provided.

Step 4 – Print your name, address, social security number and date of birth and then sign it in front of a notary public.

Step 5 – This affidavit can be used to gather assets of the decedent by presenting the properly executed affidavit to those holding property of the decedent.
