An Arkansas 3-day notice to quit (non-payment of rent) is sent to notify a tenant when rent goes unpaid. The landlord can give legal notice and begin eviction proceedings when the tenant fails to pay rent within five (5) days of the due date. Therefore, the landlord must wait five days before issuing the tenant a three (3) day notice to pay or quit.
The 3-day notice to quit should be delivered personally to the tenant in default. If there is an unsuccessful attempt to serve the tenant and no person is found, the landlord may leave a copy of the notice to quit affixed to the most conspicuous part of the premises.
Grace Period (A.C.A. § 18-17-701(b)) – The notice to quit may not be sent to the tenant until five (5) days after the rent due date.
