Texas General Warranty Deed Form

A Texas general warranty deed is a form that transfers real estate ownership in the clearest possible manner and promises the new owner that there are no title defects such as liens or encumbrances. A deed is usually prepared after a purchase and sale agreement has been signed. After the exchange is complete, this form should be brought to the County Clerk’s Office where it can be recorded.

LawsTitle 2, Chapter 5 – Conveyances

Signing Requirements – Must be authorized with the grantor(s) in front of two (2) witnesses or a Notary Public.[1]

Notices and Disclosures

  • Required Language – In uppercase letters and at least 12-point boldfaced font the following must be on all deeds filed in Texas:[2]

NOTICE OF CONFIDENTIALITY RIGHTS: IF YOU ARE A NATURAL PERSON, YOU MAY REMOVE OR STRIKE ANY OR ALL OF THE FOLLOWING INFORMATION FROM ANY INSTRUMENT THAT TRANSFERS AN INTEREST IN REAL PROPERTY BEFORE IT IS FILED FOR RECORD IN THE PUBLIC RECORDS: YOUR SOCIAL SECURITY NUMBER OR YOUR DRIVER’S LICENSE NUMBER.

Recording the Deed

Per V.T.C.A., Property Code § 11.001, the deed must be filed at the County Clerk’s Office.
