Privately Selling a Firearm

Anyone legally owning a firearm can also sell one in a private transaction. However, the seller and buyer must utilize a federally licensed gun dealer to conduct a background check on the buyer before completing the ownership change.[1]

Prohibited from Buying

Any person is prohibited from possessing or purchasing a firearm if that person:[2]

  • Is under 18 years of age;
  • While a minor was found to be within the jurisdiction of the juvenile court for having committed an act which, if committed by an adult, would constitute a felony or a misdemeanor involving violence;[3] and
    • Was discharged from the jurisdiction of the juvenile court within four years before being charged under this section;
  • Has been convicted of a felony;
  • Was committed to the Oregon Health Authority;[4]
  • Was found to be a person with mental illness and subject to an order that the person be prohibited from purchasing or possessing a firearm as a result of that mental illness;
  • Is presently subject to an order[5] prohibiting the person from purchasing or possessing a firearm;
  • Has been found guilty except for insanity[6] of a felony; or
  • The possession of the firearm by the person is prohibited.[7]

Registering a Firearm

Oregon does not have any laws requiring firearms owners to register their weapons with the state.

Concealed Carry

Anyone wishing to carry a concealed weapon in Oregon must first obtain a Concealed Handgun License (CHL) from their local sheriff’s department.

How to Apply

An individual must be at least 21 to apply for a concealed handgun license.[8]

  1. Obtain an application for a Concealed Handgun License from the applicant’s local sheriff’s department.
  2. Complete the application and attach proof of competence with a firearm;[9] residency in the county where the applicant is applying; and U.S. citizenship or permanent residency.
  3. Submit the application to the local sheriff’s department.
  4. Submit to fingerprinting and photographing with the local sheriff’s department.
  5. Pass the federally required background check.
  6. The sheriff’s office will approve or deny the application within 45 days of receiving it.[10]

Reciprocity

Oregon does not have laws honoring concealed carry licenses from other states. County sheriff’s departments can waive the residency requirement for an Oregon Concealed Handgun License on a case-by-case basis.
