A New York 30-Day Notice to Quit (Non-Compliance) is a legal document served to a tenant based on a claim that the tenant has breached a provision within the lease. After providing this information to the court, the court shall issue a 30-day warrant during which time the tenant must either correct the breach or be evicted.
If the tenant fails to correct the breach and also fails to move out from the premises, the landlord can start a licensee holdover case in Housing Court.

How to Write
Step 1 – It’s the landlord’s duty to correctly fill out the notice by first starting with the information needed above the dotted line. Complete the following:
- Date
- Landlord’s name, Contact Name, Email Address, and Phone Number
- Tenant’s Full Name, Address, City, State, Apt # (if any), City, State, and Zip Code
Step 2 – Below the dotted line, complete the following:
- Description of Violation
- Move-Out Date if violation goes uncured.
- Landlord’s Signature
Step 3 – Complete the Certificate of Service with the following information:
- Date Served and Time
- Method of Delivery
