Signing Requirements

Only the principal is legally required to sign the power of attorney. However, it is generally recommended that a real estate power of attorney also be notarized if it will be used to authorize the conveyance of property.[2][3]

Recording

Although not explicitly required by state statute, it is recommended that a real estate power of attorney that is used to authorize the buying or selling of real property be recorded with the Office of the Chancery Clerk.[2][3]
