The Idaho prenuptial agreement, also referred to as a “premarital agreement,” is a contract signed by potential spouses prior to marriage. It is used by couples of every financial background, not just the wealthy, to define the management of finances and property during the marriage and in the case of a divorce. A document such as this is used when one or both spouses have existing businesses or financial accounts that they would like to hold independently of their spouse and protect should the marriage end in separation.
Signing Requirements (§ 32-922) A prenuptial agreement must be signed by both parties. No witness or notary public is required but recommended.
