A North Carolina prenuptial agreement is used by couples who plan to marry and would like to define the property rights and obligations of each party in the event of a divorce or death. The agreement provides instructions concerning the division of assets between spouses. Without such directions in place, the couple will have no say in who gets what which might ultimately affect a spouse’s claim to real property, business ownership, life insurance benefits, or inheritance left for a surviving child. The agreement is enforceable if executed in accordance with § 52B-7 of the North Carolina General Statutes.

Signing Requirements (§ 52B-3) – Both parties need to sign for the agreement to be legally valid; a notary acknowledgment is also recommended but not required.
