A Vermont residential purchase agreement is a contract that a potential home buyer will negotiate with a seller when offering to purchase a property. The process of purchasing a home begins with the buyer outlining the terms in the contract and providing the document to the seller or their agent.

State Laws

Agent Duties – A licensed real estate agent representing the seller is legally required to disclose to the buyer all material facts about the property within their knowledge.[1]

Seller Duties – While Vermont laws don’t explicitly require the seller to provide a comprehensive property condition disclosure, they must disclose to the buyer if the property is:

  • Located in a FEMA flood hazard area or was subject to flooding damage during the seller’s ownership of property;[2] or
  • Not served by a public water system and uses a potable water supply.[3]

Seller’s Disclosures (3)

Seller’s Property Disclosure (conditional) – If a seller sells their home using the services of a licensed agent, the agent must provide the buyer with a property disclosure statement that informs the buyer of any material defects and other details pertaining to the condition of the property.
