Virginia Month-to-Month Lease Agreement

A Virginia month-to-month rental agreement, or “tenancy-at-will,” is a lease contract that renews monthly. The lease ends when either the landlord or tenant issues written notice.

Laws

  • Minimum Termination Period – 30 days for a month-to-month lease or seven days for a week-to-week, unless the parties agree in writing to terminate at an earlier date.[1] If the landlord is terminating multiple month-to-month leases in a multifamily building within 30 days (over 20 leases or over 50% of the leases on the property), 60 days’ notice is required.[2]
  • Increasing Rent – Landlords can increase the rent by providing notice to accept the new terms or end the lease 30 days in advance.
