The Texas security deposit demand letter is a document that a tenant may use to serve a landlord who has failed to return a deposit within thirty (30) days from the date that the tenant vacated the rental property. Tenants must provide their landlords with a forwarding address in order to receive a notice of damages and charges and/or security deposit refund. However, the tenant does not lose their right to a refund even if they haven’t provided the landlord with an address. Landlords who wrongfully withhold a security deposit are liable for up to three (3) times the full amount plus attorney fees.
