Louisiana Subcontractor Agreement

A Louisiana subcontractor agreement is used by contractors to assign certain portions of work to other individuals or companies. Contractors will often require the services of a subcontractor after agreeing to perform work for a client and additional skills are needed to complete the project effectively. Hiring a subcontractor can bring a particular set of abilities to a job site which can aid the primary contractor by eliminating the need to hire and train new employees. Whatever the need for the subcontractor may be, an agreement should be drafted to define the subcontractor’s wage, responsibilities, legal obligations, and other terms by which the subcontractor must operate.

“Subcontractor” Definition

(a) “Subcontractor” means a person who contracts to perform a scope of work that is a part of the scope of work contained in the principal contract.

(b) “Subcontractor” shall not include any person, supplier, or manufacturer who assembles, repairs, maintains, moves, puts up, tears down, or disassembles any patented or proprietary equipment supplied by such person to a contractor to be used solely by the contractor for a construction undertaking.
