The Hawaii 10-Day Notice to Quit (Non-Compliance) is a form used by a landlord when a tenant breaches any rule under § 521-72 which compromises any breach other than the non-payment of rent. The notice shall detail the breach and the amount of time the tenant has to remedy the breach, which cannot be less than 10 days. If the tenant continues to violate the breach after the allotted time period, the landlord may terminate the rental agreement.

The only exception when it comes to the amount of time allowed for the tenant to remedy a breach, which is no less than 10 days, is when the tenant causes or threatens to cause damage to any person. If the breach continues to recur after the date specified in the notice, the landlord can issue a summary proceeding for possession within 30 days after the breach.

How to Write

Step 1 – Complete the 10 day notice to quit by accurately completing the information that pertains to the landlord, tenant, dwelling unit of the tenant and a description of the breach.

  • Names of Tenant(s)
  • Address of the tenant’s dwelling unit
  • Description of the non-compliance (breach)
  • A signature, printed name, address and date is required from the landlord

Step 2 – Once the form is completed, deliver the notice to the tenant’s dwelling unit. If the tenant is unavailable when delivery is made, leave the notice in an obvious spot where the tenant can easily spot it.
