A Louisiana power of attorney revocation is used by a principal to revoke a previously executed power of attorney. The revocation process is only completed when the principal has given notice of the cancelation to the original agent and to any other institutions that may be relying on the original power of attorney agreement.

Financial Powers

A financial power of attorney is canceled if:[1][2]

  • The principal dies;
  • The principal becomes incapacitated and the power of attorney is not durable;
  • The principal terminates the power of attorney (with a form); or
  • The agent resigns, becomes incapacitated, or dies.

Medical Powers

A health care power of attorney can be revoked by the principal at any time by:[3]

  • A written revocation if they are mentally capable;
  • Communicating the revocation to the treating physician or other provider if they are incapable otherwise; or
  • Executing a new health care power of attorney that replaces the old one.
