A Massachusetts land contract records the terms in a purchase and sale agreement between two parties for undeveloped land. The document contains everything from the agreed-upon purchase price to the legal descriptors of the land/lot as they appear on the deed. Both parties can negotiate terms until reaching a final accord, at which point they must each sign the contract. Upon striking a mutual deal and executing the agreement, the parties shall schedule a closing date in order to exchange any funds and formally transfer the property deed.

- Seller’s Property Disclosure Statement – A seller is not required by law to provide potential buyers with a disclosure statement of the land’s condition. However, the seller may opt to do so at their discretion.
- Where to Record? (MA Gen L ch 36 § 12) – Deeds must be submitted to the Registry of Deeds Office of the district in which the property is located along with the Required Filing Fee.
