A Delaware month-to-month lease agreement is a contract for a non-fixed lease term between a landlord and tenant. The agreement automatically renews at the end of each month unless one of the parties decides to terminate.

Laws

Minimum Termination Period – 60 days’ notice is required to terminate a month-to-month lease.[1] Delaware law does not address required notice for week-to-week tenancies.

Increasing Rent – The landlord must notify the tenant 60 days in advance if rent is to be increased.[2]
