- Minimum Termination Period – Outside of New York City, one month’s notice is sufficient to terminate a month-to-month lease.[1] Within New York City, the required notice depends on the time the tenant has occupied the unit:

- Less than one year – 30 days
- Between one and two years – 60 days
- Two years or more – 90 days[2]

- Increasing Rent – The required notice for increasing rent by 5% or more is equal to the termination periods above.[3]
