New York Month-to-Month Lease Agreement

A New York month-to-month rental agreement is a rental contract that automatically renews until terminated by either the landlord or tenant. In New York City, tenants become entitled to additional protections based on the length of time they have lived on the premises.

Laws

  • Minimum Termination Period – Outside of New York City, one month’s notice is sufficient to terminate a month-to-month lease.[1] Within New York City, the required notice depends on the time the tenant has occupied the unit:
      • Less than one year – 30 days
      • Between one and two years – 60 days
      • Two years or more – 90 days[2]
  • Increasing Rent – The required notice for increasing rent by 5% or more is equal to the termination periods above.[3]
