The New York Month to Month Rental Agreement is a legal document whereas a landlord and tenant agree that the agreement is renewed at the end of each month as long as the rent is paid on time and the landlord has not provided notice to vacate for whatever the reason. If the renter decides to leave at the end of the month, then the tenant(s) may do so without breaking the written agreement by providing notice pursuant to to § 232-b which states that a tenant or landlord may end the lease with notice of one month written in advance.

Basically, the renter may remain in the rental unit until either the landlord or tenant should decide otherwise. Month to month rentals are beneficial inasmuch as they are much more flexible for the tenant(s), especially when they are unsure exactly how long they will need to remain in a particular property. If the tenant(s) are unsure whether or not they completely understand the language of the agreement, they may consider consultation with an attorney of their choice to clarify.

How To Write

Step 1 – Download the document-

  • Enter the full legal name of the landlord
  • Enter the full legal name of the tenant(s)
  • Enter the date of the contract completion

Step 2 – Premises –

  • Enter the address of the premises

Step 3 – Lease Term –

  • Enter the date, in mm/dd/yyyy, the agreement will commence
  • Tenant must carefully read and agree to the remainder of the paragraph

Step 4 – Lease Payments

  • Enter the dollar amount that the tenant(s) will agree to pay the landlord on a monthly basis
  • Provide the address where the tenant(s) will pay the rent each month
  • Tenant(s) must read and understand the “Late Charges” section of the agreement as this section will be enforced
  • Enter the fee amount the tenant(s) will pay as late charge
  • Enter the amount of the Security Deposit that will be paid to and held in escrow by the landlord – tenant(s) must read the remainder of this section carefully and understand it, prior to signing this agreement
