The Texas Apartment Association Residential Lease Agreement is a legal document that will provide, in writing, all of the terms and conditions of a residential rental agreement between a landlord and tenant. The agreement will last for a specified time frame and the tenant, therefore, unless otherwise stated in writing by the landlord, will be responsible for all aspects of the agreement as written from the commencement of the lease to expiration. The landlord must carefully complete the document and the tenant must carefully read and agree to the entire content of the document prior to provision of signature.

How To Write

Step 1 – Parties – Enter the required information:

  • Provide the names of all individuals who will be signing occupants in the residence
  • Enter the name of the landlord
  • Enter the name of the apartment community
  • Enter the street address
  • City, State. Zip Code
  • Tenant(s) should read and agree to the remainder of the section

Step 2 – Occupants – Provide:

  • The names of all occupants who are not of age and/or who will not sign the agreement
  • Landlord must enter a number of allowable days in which guest may visit, consecutively

Step 3 – Lease Term – Landlord must complete the following fields:

  • Enter the date in which the agreement shall begin in dd/mm/yyyy format
  • Enter the date of expiration of the agreement in dd/mm/yyyy format
  • If the tenant would like to renew the agreement, the landlord must provide a number of days in which the tenant(s) have to renew their lease or allow the agreement to go month to month – If the tenant(s) intend to move out, they must provide 30 days written notice in order to remain in compliance

Step 4 – Security Deposit – The landlord must:

  • Enter the amount of the security deposit that will be expected to be paid before or on the date of the execution of the agreement
  • Within the paragraph, the landlord must indicate whether or not this amount includes any pet deposits

Step 5 – Keys, Furniture and Affidavit of Move Out – Landlord must complete the following information:

  • Enter the number of keys provided to the apartment, by the landlord
  • Enter the number of keys provided to the mailbox, by the landlord
  • Enter and specify the number of any other access keys that will be provided
  • By checking the appropriate box, indicate whether the apartment will be furnished or unfurnished

Step 6 – Rent and Charges – Enter and select the following:

  • Enter the agreed amount of rent that shall be paid by the tenant(s) to the landlord on or before the beginning of each month
  • Select method of acceptable payment
  • If selection involves a physical address, supply that address for delivery of rental payments
  • If there will be proration of the rent, enter the prorated amount
  • Enter the year of the proration
  • Enter a date in which the rent, if not paid, is considered late
  • Enter a late charge fee to be added to the rent if not paid on time
  • If the landlord chooses to include a daily late fee for late payments, enter that amount
  • Enter the amount that will expect to be paid for any returned check charges
  • Enter the amount that will be charged to the tenant(s) for any unreported animals both in deposit and daily charge until the animal(s) are removed

Step 7 – Utilities – Landlord must select the utilities and services that will be paid by the landlord –

  • As for any utilities to be paid by the tenant(s), should they fail to change the utility or service, landlord must enter an amount that the tenant(s) will be responsible for the violation. The same will apply at move out

Step 8 – Insurance – Select one of the following:

  • Required to maintain renter’s insurance
  • Not required to maintain renter’s or liability insurance

Step 9 – Security Devices – Enter the following:

  • The tenant(s) have a right to request some specific security devices. If the tenant(s) would like to request these devices, list them on the lines provided – Leave blank if no devices are being requested in the present
  • If at a later date, a device is requested and installed, the landlord may make an addendum to the contract and provide a copy to the tenant(s) at that time

Step 10 – Special Provisions and “What If” Clauses –

  • Landlord must provide any additional agreements or rules in this section

Step 11 – Titled Sections – Tenant(s) and landlords must read and agree to all sections as follows:

Step 12 – Signatures – Enter as follows:

  • Signatures of all residents 18 and over
  • Date of Signatures
  • AND
  • Owner or Owner’s Representative (if there is a signatory beyond the owner)
  • Address and phone number of owner’s representative for the purpose of notices
  • After hours telephone number(s)
  • AND
  • Date of the completion of the document in mm/dd/yyyy format
