The Utah Month to Month Rental Agreement is a legal document, also known as an “at will” agreement, that is used between landlord and tenant for a month to month rental agreement for residential property. According to §  78B-6-802, the tenant would be allowed to continue to rent the property on a monthly basis until either the tenant or landlord delivers a 15 day notice to vacate the premises to the other.

How To Write

Step 1 – Deposit Receipt – Enter the amount due for each item as follows:

  • Enter the total amount due prior to move in
  • State the method in which the payment must be made to the landlord
  • Enter the dates for the first month’s rent
  • Enter the total
  • Enter the amount received
  • Enter the entire amount of rent due prior to move in
  • AND
  • Enter the dates for the first security deposit
  • Enter the total
  • Enter the amount received
  • Enter the entire amount of security due prior to move in
  • AND
  • Enter the dates for any other fees
  • Enter the total
  • Enter the amount received
  • Enter the entire amount of any other fees due prior to move in
  • AND
  • In the “Total” columns, enter the amounts due after calculation

Step 2 – Parties – Provide the following information

  • Enter the name of the landlord
  • Provide the tenant(s) name(s)

Step 3 – Property Address – Enter:

  • The physical address of the property

Step 4 – Term – Provide:

  • The date in which the agreement shall commence and shall continue on a month to month basis until intent to vacate is presented by either party

Step 5 – Rent – Enter the following:

  • The sum of the security deposit due prior to move in
  • Enter the portion of the deposit that will be refundable and the portion that will be non-refundable

Step 6 – Other Fees – Specify the following in the line provided:

  • If there are any other miscellaneous fees, enter them in the line provided on the agreement

Step 7 – Titled Sections – The tenant(s) must carefully read and agree to all other sections as follows:

  • Initial Payment
  • Utilities (landlord must enter any exceptions to utilities or services that the tenant(s) would be responsible to pay)
  • Late Fees and Bad Checks
  • Accounting Method
  • Use and Occupants (landlord must enter the number of occupants allowed to reside on the property)
  • Inventory (landlord must enter any furnishings that will be a part of this rental)
  • Parking (landlord must select whether or not the tenant(s) will be allowed to park vehicles on the property. If so, specify the space number(s) if any, that the tenant(s) will be allowed to use)
  • Subletting or Assigning
  • Conditions of Premises (landlord must enter any exceptions to the proper repair and condition of the property)
  • Alterations
  • Noise and Nuisance
  • House Rules
  • Pets
  • Landlord’s Right of Entry and Inspection
  • Repairs by Landlord
  • Security Not Promised
  • Tenant(s) Insurance

Step 8 – Signatures – Provide the following:

  • Date the landlord’s signature in mm/dd/yyyy format
  • Signature of landlord or agent
  • AND
  • Date the tenant’s signature(s)
  • Provide all signatures of any tenant’s over the age of 18 that will become occupants on the premises
