Hawaii-Security-Deposit-Demand-LetterA Hawaii security deposit demand letter is used by a tenant to demand the refund of a security deposit from a landlord. If fourteen (14) days have passed since the termination of the lease and the landlord has not returned the deposit or provided a notice stating they are retaining a portion thereof, the tenant may send the landlord the security deposit demand letter. After the fourteen-day time period, the landlord shall not be entitled to retain any portion of the security deposit and must return the entire deposit to the tenant. Failure to comply with the demand letter could result in a small claims lawsuit being filed by the tenant against the landlord, and the court may award the tenant damages equal to three times the initial deposit amount.
