Virginia Security Deposit Demand Letter

A Virginia security deposit demand letter is a document sent to a landlord who has failed to return a security deposit within the mandatory 45-day period from the lease termination date. State law stipulates that the tenant must give their landlord a forwarding address to facilitate the security deposit refund.

If the deposit is not returned or collected within one year from the end of the 45-day period, the landlord must send the funds to the Virginia Department of Housing and Community Development, payable to the State Treasury. In the event that the landlord fails to comply or makes unfair deductions, the tenant may sue them in Small Claims Court.[1]
