Virginia Security Deposit Demand Letter

The Virginia security deposit demand letter is a document which is sent to a landlord who has failed to return a security deposit within the mandatory 45-day period from the lease termination date. State law stipulates that the tenant must give their landlord a forwarding address in order to facilitate the security deposit refund. If the deposit is not returned or collected within one (1) year from the end of the forty-five (45) day period, the landlord must send any money due to the tenant to the Virginia Department of Housing and Community Development, payable to the State Treasure. In the event that the landlord fails to comply or makes unfair deductions, the tenant may sue them in Small Claims Court.
