A South Dakota land contract sets binding terms for a real estate transaction involving vacant land. The contract can be utilized for either residential or commercial transfers, and it contains the information of the buyer and seller as well as that of the land/lot being sold. The parties shall reach mutual terms for the sale through negotiations, recording the agreed-upon purchase price and relevant financial contingencies on the finalized document. Upon executing the contract, the parties will then attend (in-person or with an agent in their place) a closing date to transfer the property deed.
Seller’s Property Condition Disclosure Statement (SD Codified L § 43-4-38) – Sellers of residential-use, improved land must furnish this disclosure to potential buyers before the closing date or the date of possession of the property, whichever comes first.
Where to Record? (SD Codified L § 43-28-1) – All deeds must be recorded with the Register of Deeds in the county where the property is situated, along with a completed Certificate of Real Estate Value.
