A Vermont land contract is a purchase agreement for vacant land, including residential and commercial property. The selling and buying parties can utilize the contract to stipulate all the terms involved in the transaction, such as the amount due at signing and any related financial provisions. Any pertinent dates and deadlines must also be set on the contract; the parties typically arrange specific dates for diligence periods and closing. Upon closing, the parties shall sign and execute the document, at which point the seller will transfer the deed to the new owner accordingly.

Supplemental Information

  • Seller’s Property Disclosure (26 V.S.A § 2296) – Sellers transferring property through the use of a licensed agent must provide buyers with a disclosure statement detailing the property’s material defects and its overall condition. Private sellers (i.e., individuals selling a property without an agent or other broker service) are not required to issue this statement since Vermont is a “buyer beware” state.
  • Where to Record? (27 V.S.A. § 402) – All deeds must be recorded in the County Clerk’s Office of the county where the property is situated.
