The Missouri Month to Month Lease Agreement Template is an easy to use contract form meant to define the specifics of an At-Will Tenancy on a dated document bearing the signatures of the participants. When a document that assigns roles to signature parties and contains terms and conditions for each signature party, it becomes binding upon being dated and signed. The act of signing one’s names is legal proof of the role and any terms and/or conditions applying to that have been accepted and agreed to by that individual. In the case of a lease, this will also place several requirements upon each role depending on various factors such as lease type.

For instance, in the State of Missouri Section 441.061.0 of Chapter 441 in the Missouri Revised Statutes will require any party in a Month-to-Month Agreement provide one month’s notice before terminating the lease. Since, an At-Will Tenancy, such as a Month-to-Month, has no actual termination date named, it is left up to the participants to decide when the agreement shall terminate. Such a requirement serves as a precaution. Individual counties and/or cities may have additional statutes governing this type of lease so it is imperative to be up to date on the local ordinance governing leases.

How to Write

Step 1 – Report the date of the lease on the first line in the first blank space.

Step 2 – Write in the Landlord’s full name on the second blank space and the Tenant’s full name on the third blank space.

Step 3 – In section 1.1, enter the address of the leased property on the blank space provided.

Step 4 – In section 1.2, enter the start date of the lease on the first blank space in this section. On the second blank space of this section, enter the number of days’ notice either party must give before terminating this lease (in this state, this can be no less than thirty days).

Step 5 – In section 2.1, fill in the monthly rent amount in the space provided.

Step 6 – In section 2.2, in this section, enter the full Name and Address for the individual who must receive the rent from the Tenant. Do this on the first and second blank spaces, respectively.

Step 7 – In section 2.3, enter the number of days, past the due date, when the rent will be considered late. Then, on the second blank space, enter the late fee the Tenant will be responsible to pay for not paying the rent on time.

Step 8 – In section 2.4, enter the penalty charge the Tenant will be responsible for paying each time a Tenant submits a bounced check as a rent payment on the first blank space.

Step 9 – In section 3.1, enter the security deposit amount the Landlord requires of the Tenant in the space provided.

Step 10 – In section 7.2, write down a list of all the utilities and/or services the Tenant must pay for or provide the leased property so long as the agreement remains in effect.

Step 11 – In section 10.1, define the number of consecutive days a Tenant may be away from the property without providing a notice prior to their absence regarding their absence.

Step 12 – In section 15.6, enter the monthly rental amount the Tenant must pay the Landlord if the Tenant remains on the property past the Termination Date either party has named.

Step 13 – In section 15.9, report the number of keys to enter the property the Tenant shall receive on the first blank space. Then on the second, report the number of mailbox keys. Finally, on the third blank space enter the charge amount the Tenant must pay if all keys are not returned.

Step 14 – The next section, titled “Additional Terms and Conditions,” will be a series paragraphs each with a checkbox. Some may require additional attention. Place a checkmark in each paragraph that shall apply. Check “Display of Signs” may advertise the property sixty days before the termination date. Check the second box (“Noise”) and enter the earliest time and latest time of day a Tenant may move furniture in or out of the property to limit the Noise the Tenant may produce. If the Tenant will be given parking, check the third box then enter the number of spaces allotted and the location those parking spaces. To limit the use of the Tenant’s Balcony, place a checkbox in the fourth box. If there are specific places that a Tenant’s bicycle must be stored, check the fifth box. To prevent the Tenant from propping open any doors (without Landlord permission), place a checkmark in the sixth box. To prevent the Tenant from having any “Liquid-Filled Furniture,” check the seventh box. If the property manager is different from the Lessor, check the eighth and enter the Name, Address, and Telephone Number of the Property Manager. If a copy of the “Building Rules” has been attached for the Tenant to read and abide by, place a checkmark in the ninth box. Finally, if there are any further agreements between Landlord and Tenant that have not been defined place a check mark in the final box of this section.

Step 15 – The end of this document requires the Landlord and all Tenants to sign and date their names.
