The North Dakota Month to Month Rental Agreement is a legal document designed to state that a landlord and tenant may agree that a rental contract may be renewed at the end of each month, as long as the rent is paid in timely manner and the landlord has not provided notice to vacate. If the renter decides to leave at the end of any given month, then the tenant(s) will be able to do so without breaking any written agreement by providing notice, according to § 47-16-07.2, which clearly states that the landlord or tenant may terminate the document with at least thirty (30) days advance notice.

The tenant may remain in the rental unit until either the landlord or tenant should decide otherwise and provides notice to vacate. Month to month rentals are beneficial inasmuch as they are flexible for the tenant(s), especially when they are unsure exactly how long they will require the rental. Tenant(s) must carefully review the entire document. Should they find they are unsure whether or not they understand the agreement, they may consider consultation with an attorney of their choice for guidance.

How To Write

Step 1 – Download the document –

  • Enter the landlord’s full name
  • Enter the tenant(s) full name(s)
  • Provide the date of the completion of the agreement in mm/dd/yyyy format

Step 2 – Premises –

  • Enter the street address where the premises is located
  • City

Step 3 – Lease Term –

  • Enter the beginning date of the lease. The lease will renew itself monthly and will only terminate when either the landlord or the tenant(s) provide notice to vacate
  • Tenant(s) should read the remainder of this portion of the document and agree to it prior to provision of signatures

Step 4 – Lease Payments –

  • Enter the amount of rent that will be paid on a monthly basis
  • Enter the address where the rent payment must be delivered

Step 5 – Late Charges –

  • Enter  the amount of days the tenant has to get their rent paid before a late fee is imposed
  • Enter the late fee amount
  • Provide a day of each month that rent must be received without breaching their contract

Step 6 – Insufficient Funds – Enter:

  • The amount that the tenant will have to pay for any check returned for insufficient funds

Step 7 – Security Deposit – Enter:

  • The amount of security deposit that will be paid to the landlord at the signing of the lease
  • Tenant(s) must read the remainder of this section so that they may understand how to retrieve all or part of the deposit when they do vacate the premises
