The North Dakota Month to Month Rental Agreement is a legal document designed to state that a landlord and tenant may agree that a rental contract may be renewed at the end of each month, as long as the rent is paid in a timely manner and the landlord has not provided notice to vacate. If the renter decides to leave at the end of any given month, then the tenant(s) will be able to do so without breaking any written agreement by providing notice, according to § 47-16-15, which clearly states that the landlord or tenant may terminate the document with at least thirty (30) days advance notice.

The tenant may remain in the rental unit until either the landlord or tenant should decide otherwise and provides notice to vacate. A month-to-month rental is beneficial inasmuch as they are flexible for the tenant(s), especially when they are unsure exactly how long they will require the rental. Tenant(s) must carefully review the entire document. Should they find they are unsure whether or not they understand the agreement, they may consider a consultation with an attorney of their choice for guidance.

Minimum Termination Period – 30 days
