South Dakota Security Deposit Demand Letter

The South Dakota security deposit demand letter is sent to landlords when they have failed to pay back the balance of a security deposit within the allotted time period. If the landlord is not taking any deductions from the original amount on account of damages (unpaid rent, repairs, etc.), they will have two (2) weeks to return the money to their tenant. Otherwise, the tenant must be given a written statement of damages and their associated repair costs, as well as the balance of the original security deposit within forty-five (45) days. Any bad faith on the part of the landlord, such as not returning a deposit or failing to provide a statement will result in fines of up to $200.
