A South Dakota security deposit demand letter is sent to landlords when they have failed to pay back the balance of a security deposit within the required time period.

Laws

If the landlord is not taking any deductions from the original amount to compensate for damages (unpaid rent, repairs, etc.), they will have two weeks to return the money to their tenant. Otherwise, they must provide the tenant with a written statement of damages and their associated repair costs, as well as the balance of the original security deposit, within 45 days. Any bad faith on the part of the landlord, such as not returning a deposit or failing to provide a statement, may result in fines of up to $200.[1]
