An Oklahoma 5-day notice to pay or quit (non-payment of rent) is a document used to notify a tenant that their rent is past due. If the tenant fails to pay rent within five days of receiving this written notice, the landlord may terminate the rental agreement.

Laws

  • Notice Period: Five days.[1]
  • Rent Grace Period: None, rent is due at the time and place agreed upon by both parties in the lease.[2]
  • Maximum Late Fee: No maximum penalty for late rent payments is established under Oklahoma state law.

Delivery Options (2)

  1. Posting the notice on the tenant’s door and sending a copy by certified mail; or
  2. Delivering the notice to the tenant or another resident of the dwelling in person.[3]

Waiver of Landlord’s Right to Terminate

If the tenant pays their past due rent within the five-day notice period, the landlord may no longer evict the tenant for failure to pay rent.[1]
