A Montana land contract documents terms and conditions of a transaction for vacant land between two parties. Through mutual negotiations, the seller and buyer must create this contract with all contractual details pertaining to the purchase and sale, such as the agreed-upon purchase price as well as any applicable financial contingencies. The parties must also include the property’s legal description as it appears on the deed for recording purposes. Upon reaching a final agreement and executing the contract, the parties shall schedule a closing date to transfer the funds accordingly.

- Seller’s Property Disclosure Statement – Sellers of residential or commercial land are not required to disclose information regarding the property to potential buyers. However, they may opt to do so by utilizing this Montana Assoc. of REALTORS form.
- Where to Record? (MT Code § 70-21-201) – Deeds must be recorded in the County Clerk and Recorder’s Office of the county in which the property is located.
