A roommate release form is used to release a departing tenant from their liabilities and obligations as a roommate of a shared rental property. The document involves both the person leaving the property and the tenants who will stay on the lease. By signing a release form, the remaining tenants agree to be responsible for the departing individual’s rental obligations.

Key Components

  • Release of departing roommate. All obligations and liabilities (i.e. rent, security deposit) made under the original lease are released to the remaining roommate(s).
  • Agreement of remaining roommate(s). The remaining roommate(s) agree to reclaim all obligations and liabilities released from the departing roommate.
  • Landlord’s consent. The form requires expressed consent from the landlord to accept the new arrangement of terms.
